1. Acceptance of Terms

By accessing and using the services provided by Desert Dexa Inc. ("Desert Dexa," "we," "us," or "our"), including DEXA scanning services and our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Provided

Desert Dexa Inc. provides two primary services:

  • DEXA Scanning Services: DEXA (Dual-Energy X-ray Absorptiometry) scanning services for body composition analysis and bone density testing. These services are intended for informational and wellness purposes.
  • Telehealth Platform Services: Technology platform connecting patients with licensed healthcare providers for medical consultations and prescription services. Desert Dexa provides the technology platform but does not directly provide medical care.

Neither service constitutes direct medical advice, diagnosis, or treatment by Desert Dexa Inc.

3. Eligibility

General Eligibility

Our services are available to all individuals who meet the applicable medical and eligibility criteria.

Telehealth Services Eligibility

To be eligible for telehealth services, you must:

  • Meet medical criteria as determined by licensed healthcare providers
  • Be able to provide complete medical history and current medications
  • Not have contraindications to prescribed treatments (see Safety Information)
  • Be physically located within an eligible state at the time of your consultation
  • Agree to ongoing monitoring and follow-up appointments

Service Areas

Telehealth services are available in 47 states (excluding Alaska, Mississippi, and New Jersey), the District of Columbia, and Puerto Rico. Our healthcare providers maintain appropriate licensing and regulatory compliance in all jurisdictions where services are offered.

You must be physically located within a state where we provide telehealth services, the District of Columbia, or Puerto Rico at the time of your telehealth consultation.

4. Medical Disclaimer

DEXA Scanning Services

Total Body DEXA Scans: Total body composition scan results provided by Desert Dexa are for informational and wellness purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider regarding any medical conditions or health concerns.

Osteoporosis Screening (Axial DEXA Scans): Osteoporosis screening DEXA scan results are interpreted by our consulting radiologist and constitute medical diagnostic information. These results should be reviewed with your healthcare provider for appropriate medical follow-up and treatment recommendations.

Telehealth Platform Services

Desert Dexa provides technology platform services only. All medical advice, prescriptions, and treatment decisions are made by independent, licensed healthcare providers. Desert Dexa does not practice medicine and is not responsible for the medical decisions, advice, or treatment provided by healthcare providers using our platform.

Prescription Medications

Prescription medications carry significant risks and are not appropriate for everyone. These medications may cause serious side effects and interactions. You must read and understand all safety information before starting any treatment.

5. FDA Disclaimers and Drug Information

Compounded Medications

Important: Some medications may be compounded by state-licensed pharmacies. Compounded medications are prepared in accordance with a prescription and have not been reviewed or approved by the FDA for safety or effectiveness. The FDA has not verified the safety or effectiveness of compounded drugs.

Brand Name vs. Compounded Medications

Both brand name and compounded medications may be prescribed through our platform. Your healthcare provider will determine the most appropriate medication based on your individual needs, insurance coverage, and medical history.

Provider Qualifications

  • Licensed physicians in good standing with state medical boards
  • Board certification in relevant specialties when applicable
  • Experience in telehealth medicine
  • Training in telehealth best practices
  • Ongoing continuing medical education requirements

Regulatory Compliance and Disciplinary History

Disciplinary Actions: Desert Dexa Inc. and its healthcare providers have no current or historical disciplinary actions, sanctions, or regulatory violations with any state medical boards or other regulatory agencies.

6. Prescription Validation and Medical Evaluation Standards

Doctor-Patient Relationship Establishment

Before any prescription can be issued, a valid doctor-patient relationship must be established through:

  • Comprehensive medical history review and documentation
  • Live video consultation with licensed healthcare provider
  • Medical evaluation appropriate for the condition being treated
  • Assessment of patient's medical needs and suitability for treatment
  • Review of current medications and potential drug interactions
  • Evaluation of contraindications and risk factors

Prescription Verification Process

All prescriptions issued through our platform undergo the following verification:

  • Verification of prescribing provider's license and qualifications
  • Confirmation that provider is licensed in patient's state
  • Review of prescription for appropriateness and safety
  • Verification of patient identity and location
  • Documentation of medical justification for prescription
  • Compliance with state and federal prescribing regulations

Prescription Dispensing Standards

All prescriptions are dispensed only by:

  • Licensed pharmacies in good standing with state boards of pharmacy
  • Pharmacies that meet all applicable regulatory requirements
  • Pharmacies that maintain appropriate state licenses in dispensing jurisdictions

7. Appointment and Payment

DEXA Scanning Services

All DEXA scan appointments must be scheduled in advance through our booking system. Payment is required at the time of service. We accept credit and debit cards only. We do not accept insurance. Cancellations must be made at least 24 hours in advance for a full refund.

Telehealth Services

Telehealth consultations must be scheduled through our platform. Payment for consultations is required prior to your appointment. Prescription medications are billed separately through our pharmacy partners.

Ongoing Monitoring Requirements

Patients prescribed medications must agree to:

  • Regular follow-up appointments as determined by your healthcare provider
  • Adherence to prescribed medication regimens
  • Participation in lifestyle modification programs when recommended
  • Reporting of side effects or concerns promptly
  • Lab work monitoring as required by your healthcare provider

Prescription and Medication Costs

Medication costs are separate from consultation fees and vary based on the specific medication prescribed, dosage, and whether brand name or compounded medications are used. All medication costs will be clearly disclosed before fulfillment.

DEXA Scanning Consent

By scheduling and receiving a DEXA scan, you acknowledge that you have been informed about the nature of the scan, including the use of low-dose X-ray technology, and you consent to the procedure. You acknowledge that there are certain contraindications for DEXA scanning, including pregnancy.

Telehealth Services Consent

By using our telehealth platform, you acknowledge and consent to:

  • Receiving medical care through telecommunication technology
  • The limitations of telehealth versus in-person medical care
  • Sharing your medical information with licensed healthcare providers through our platform
  • Recording of telehealth sessions for quality assurance (when applicable)

Medication Consent

Before receiving any medication prescription, you must provide informed consent acknowledging:

  • Understanding of potential serious side effects including thyroid tumors and pancreatitis
  • Commitment to ongoing monitoring and follow-up care
  • Understanding that treatment results may vary and outcomes are not guaranteed
  • Agreement to immediately report any concerning symptoms
  • Understanding of the importance of lifestyle modifications alongside medication

12. Contraindications

DEXA Scanning Contraindications

DEXA scanning is not recommended for:

  • Pregnant women or women who may be pregnant
  • Individuals who have had contrast dye or barium studies within 7 days
  • Individuals who exceed the weight limit of the scanning equipment (450 lbs)

Medication Contraindications

Certain medications may be contraindicated for individuals with:

  • Personal or family history of medullary thyroid carcinoma (MTC)
  • Multiple Endocrine Neoplasia syndrome type 2 (MEN 2)
  • Type 1 diabetes
  • Severe gastroparesis
  • History of pancreatitis
  • Pregnancy or breastfeeding
  • Allergy to prescribed medications or any medication components

Additional caution is required for patients with kidney disease, liver disease, or history of gallbladder problems.

13. Results and Records

DEXA scan results will be provided to you immediately following your scan. You will receive both printed and electronic copies of your results. We maintain records of your scans for comparison purposes and as required by law. You may request copies of your records at any time.

14. Limitation of Liability

To the fullest extent permitted by law, Desert Dexa Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

15. Indemnification

You agree to indemnify, defend, and hold harmless Desert Dexa Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of our services or violation of these Terms.

16. Third-Party Services and Partner Disclosure

We may use third-party services for scheduling, payment processing, and other business operations. Your use of these services may be subject to additional terms and conditions. We are not responsible for the practices or policies of these third parties.
